Sonrisa Chocolates LLC, d/b/a Cacao Nibbles, recognizes and respects each individual user's privacy and had created this Privacy Statement to demonstrate that commitment. Although Cacao Nibbles does not require that information be disclosed by visitors of the www.cacaonibbles.com Web site (the "Web site"), certain services offered by the Web site require that personal information (defined below) be submitted by those who wish to take advantage of those services.

The Information We Collect

In order to sign-up for Cacao Nibbles electronic newsletter, Nibbles News, Cacao Nibbles may request and collect the following information from you: first and last name and email address. By submitting this information, you have an opportunity to receive promotional and marketing information about products and services. We do not participate in bulk email solicitations that you have not consented to receiving (i.e., "spam"). If you wish to receive Nibbles News, you may opt-out of receiving such materials by following the opt-out instructions or by emailing us at contact@cacaonibbles.com.

At the time you make a purchase request, Cacao Nibbles may request and collect the following information from you: first and last name, address, credit card number, email address and phone number. Information is used only to complete the order. We do not share this information with outside parties except to the extent necessary to complete the order.

Cacao Nibbles does not knowingly collect any personal information from or about a child under the age of 18 without consent of the child's parent or legal guardian.

Sharing and Usage of the Information

Cacao Nibbles will use the personal information for the purposes indicated at the time you voluntarily provide such information. By requesting such services, you consent to disclosure of your personal information. Cacao Nibbles does not sell or disclose customer lists or email address lists, or pass on other personal information to third party advertisers. We may use, sell or disclose personal information in the following circumstances:

Transactional Processing. Cacao Nibbles may use your personal information to create a convenient, easy-to-use shopping experience that includes an online "shopping cart" that allows you to track selected products and proceed with purchase. Also we may share transactional information with entities as is necessary to process credit card payments or other purchasing or delivery systems.

Legal Requirement. Cacao Nibbles may use your personal information: (a) to conform with the law, respond to claims or comply with legal process served on Cacao Nibbles (e.g., a lawful subpoena, warrant or court order); (b) to enforce or apply our policies or agreements (including to initiate, render, bill and collect for amounts owned to us); (c) to protect and defend our user's rights to property, the Web site, employees, guests or the public, including fraudulent, abusive or unlawful use of our Web site; or (d) if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.

Company Sale. Information collected through the Web site is considered a trade secret of Cacao Nibbles. As the owner of such information, Cacao Nibbles may disclose or sell such information as an asset of the company in conjunction with the sale to a third party of our company or a portion of our assets.

Aggregate Information. Cacao Nibbles collects aggregate information about you and your use of our Web site whenever you visit us online. For instance, we may collect various forms of "click stream" information such as entry and exit points for our Web site (i.e., referring URLs or domains), site traffic statistics, page views, impressions and operating system and browser type. In addition, when users request pages on our Web site, our servers automatically log their IP addresses. An IP address is a number that is automatically assigned to your computer whenever you are surfing the Web. The aggregate information generally will not personally identify you or be correlated to you individually for external purposes.

Third Party Web sites and Practices

Cacao Nibbles is not responsible for the content or the privacy policies of Web sites to which we may provide links or the Web sites of our advertisers or partners. The privacy policy of an advertiser or promotional service appearing at our site may differ from ours. We encourage you to review and understand their privacy practices before providing them with information.
